1. Acceptance of Terms
By installing, configuring, or using Gold-B's Agent ("the Application"), you ("the User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Application.
2. Description of Service
Gold-B's Agent is a self-hosted multi-channel messaging automation platform that runs locally on the user's hardware via Docker containers. The Application provides:
- Multi-channel message processing and responses (WhatsApp, Telegram, Instagram, Facebook Messenger, SMS, Email)
- Keyword-based rule matching and template-based replies
- A visual flow builder for designing complex automation workflows
- AI-powered response generation via third-party AI providers
- Knowledge base with document upload (PDF, DOCX, TXT) and AI-powered retrieval (RAG)
- Knowledge Sources — automated data sync from 10 platforms into AI knowledge agents
- Optional integrations with Google (Sheets, Drive, Gmail, Calendar) and Microsoft 365 (OneDrive, Outlook, Calendar, Excel)
- Lead ingestion from multiple sources (Facebook Ads, Zapier, webhooks, manual entry)
- A web-based administration panel for configuration and monitoring
3. Self-Hosted Nature
The Application is installed and operated entirely on your own hardware. You are solely responsible for:
- Maintaining the hardware and software environment required to run the Application
- Securing access to the administration panel and all credentials
- Ensuring compliance with applicable laws regarding automated messaging in your jurisdiction
- Backing up your configuration and data
4. Third-Party Services
The Application integrates with third-party services that are governed by their own terms and policies:
- WhatsApp / Meta: Use of WhatsApp automation is subject to WhatsApp's Terms of Service. You are responsible for ensuring your use complies with WhatsApp's policies on automated and bulk messaging.
- Instagram & Facebook Messenger (Meta): Use of Instagram and Messenger automation is subject to Meta Platform Terms and Meta Developer Policies.
- Telegram: Use of Telegram Bot API is subject to Telegram's Terms of Service.
- Twilio (SMS): SMS messaging is provided via Twilio and is subject to Twilio's Terms of Service. You are responsible for compliance with applicable telecommunications regulations.
- Google APIs: Access to Google services (Sheets, Drive, Gmail, Calendar) is subject to Google's Terms of Service. The Application's use of Google data is described in our Privacy Policy.
- Microsoft 365 / Graph API: Access to Microsoft services (OneDrive, Outlook, Calendar, Excel) is subject to Microsoft Services Agreement. The Application's use of Microsoft data is described in our Privacy Policy.
- AI Providers: If you configure an AI provider (Gemini, OpenAI, Anthropic, xAI, Groq, Qwen), your use is subject to that provider's terms of service and your own API key agreement with them.
5. User Responsibilities
You agree to:
- Use the Application in compliance with all applicable local, national, and international laws and regulations
- Not use the Application for spam, harassment, phishing, or any unlawful purpose
- Not use the Application to send unsolicited bulk messages in violation of anti-spam laws
- Keep your gateway password and API credentials secure
- Respect the privacy and rights of individuals whose messages are processed by the Application
- Obtain any necessary consents before processing personal data through the Application
6. Google API Usage
When using Google integrations, you additionally agree to:
- Comply with the Google API Services User Data Policy
- Only connect Google accounts that you own or have authorization to use
- Review and understand which Google scopes are requested before authorizing access
- Revoke access if you no longer wish the Application to interact with your Google data
7. Microsoft 365 API Usage
When using Microsoft 365 integrations, you additionally agree to:
- Comply with the Microsoft API Terms of Use
- Only connect Microsoft accounts that you own or have authorization to use
- Review and understand which Microsoft Graph permissions are requested before authorizing access
- Revoke access if you no longer wish the Application to interact with your Microsoft data
8. Intellectual Property
The Application's source code, documentation, and branding are the property of Gold-B's Agent. The Application is built on the OpenClaw platform, which retains its own intellectual property rights.
You are granted a non-exclusive, non-transferable license to install and use the Application for your own personal or business purposes.
9. Disclaimer of Warranties
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Application will be uninterrupted, error-free, or secure
- AI-generated responses will be accurate, appropriate, or legally compliant
- Third-party services (WhatsApp, Google, AI providers) will remain available or compatible
- Automated messages sent by the Application will be delivered successfully
10. Limitation of Liability
To the maximum extent permitted by applicable law, Gold-B's Agent and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of or inability to use the Application
- Any actions taken by WhatsApp, Google, or other third-party services (including account suspension or termination)
- Content generated by AI providers through the Application
- Loss of data due to hardware failure, misconfiguration, or software bugs
- Unauthorized access to your installation due to inadequate security measures
11. Indemnification
You agree to indemnify and hold harmless Gold-B's Agent and its developers from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Application, violation of these Terms, or infringement of any third-party rights.
12. Termination
Since the Application is self-hosted, you may stop using it at any time by uninstalling it from your machine. Upon uninstallation:
- All local data and configuration are removed
- Google and Microsoft OAuth tokens are deleted from your machine (you may also revoke access from your Google Account or Microsoft Account)
- No residual data is retained by us, as we do not operate any external servers
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be included in new versions of the Application. Continued use of the Application after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law provisions.
